Safe Work Australia has opened public consultation regarding proposed changes to the resolution of workplace health and safety disputes under the national model laws.
According to the NSCA Foundation, the consultation seeks input on options including the creation of a specialist WHS tribunal and the expanded use of alternative dispute resolution mechanisms, such as mediation and conciliation. The publication notes that the proposed reforms aim to make the system faster and more accessible, addressing current processes described as slow and costly.
The NSCA Foundation reports that the reforms are particularly relevant to office-based employers due to a rapid increase in psychosocial hazard disputes. As regulators increase enforcement regarding mental health, bullying, and excessive workloads, formal WHS complaints and investigations are rising.
The consultation paper is available on the Safe Work Australia website. Submissions can be lodged via the SWA Consultation Hub until 17 April 2026.
