New Guide Released: Workers Compensation Coverage of Contractors

Determining whether a contractor should be classified as a ‘worker’ under the Workers’ Compensation and Injury Management Act 1981 can be complex. This question often arises when employers, or their insurance brokers, are applying for or renewing a workers compensation insurance policy.

To provide clarity, WorkCover WA has released a new Explanatory Guide and Assessment Tool to help employers, contractors, insurers and brokers better understand coverage obligations. The guide offers practical advice and step-by-step support in working out whether a contractor falls within the definition of a worker or whether they are excluded.

This resource aims to reduce uncertainty and improve compliance by ensuring that businesses apply the legislation correctly when arranging workers compensation insurance. It will be particularly useful for employers who regularly engage contractors, as well as for brokers and insurers assisting clients with policy applications and renewals.

Employers are encouraged to familiarise themselves with the guide and incorporate it into their insurance and contractor engagement processes to ensure workers are adequately protected and obligations under the Act are met.
