Understanding Sexual Harassment & Discrimination
This module helps workers understand what constitutes sexual harassment, sex-based harassment, discrimination, and victimisation in the workplace. It outlines legal protections, examples of unlawful conduct, and the positive duty of employers and employees to prevent and address such behaviour. The module also covers liability, complaint procedures, and the importance of fostering a safe and respectful workplace culture through proactive leadership and bystander support.
By the end of this module, you will be able to understand:
- Legal obligations and definitions
- How to recognise sexual harassment and discrimination
- How to prevent and respond to inappropriate behaviour.
Relevant Australian Legislation:
- Sex Discrimination Act 1984 (Cth) – Prohibits sexual harassment, sex-based harassment, and discrimination on the basis of sex.
- Fair Work Act 2009 (Cth) – Offers protections against unlawful workplace behaviour, including sexual harassment.
- Australian Human Rights Commission Act 1986 (Cth) – Supports complaints and investigations related to discrimination.
- Work Health and Safety Act 2011 (Cth) – Includes responsibilities for psychological safety.
- Respect@Work legislation reforms (2022–2023) – Introduced a positive duty on employers to eliminate sexual harassment and hostile workplace environments.
